sairamec Posted March 2, 2015 Report Posted March 2, 2015 Hi, My brother has applied for H1B application through an employer here in 2012 and it was approved but he didn't went for stamping because the consultancy had been blacklisted. Now we are trying to apply in 2015 with a different employer with the same old approved application. But the old employer has got back to us and saying that this rule has been changed from the past one year: If the employee did not go to Visa stamping at all and did not enter US with this application at all, then there is no point in filing a new one on the same petition. Apparently one of the other employee who did this and went for stamping, his visa has been rejected at the consulate and this has earned him a bad remark on his visa status. Can anyone who is well versed with this advise us on our options? Thanks, Quote
