One is the group who has filed I-485 application and waiting for the I-485 approval when visa number becomes current for her or him. The second group is those who have approved I-140 petition and eager to go into the mainstream labor market, more or less free from hostage level of their lives pending the visa number current. The third group is those who are still in labor certification process or pending I-140 stage. The third group has no immediate interest and stake for the June Visa Bulletin, but the first and second group are. Nowadays, the second group got into the center of the employment-based immigrant community's focus and the impact of the Visa Bulletin reform is extremely important. There are two ways to achieve I-140 EAD. One is opening up visa cut-off date such that those with approved I-140 can file I-485 along with EAD just as the precedent in 2007. For this one, we do not need a rule-making process. Another way to get to it is to expand the existing AC 21 law interpretation to include the approved I-140. for portability and EAD eligibility. This rule-making process is already in the agency's plan and scheduled to be released as early as October 2015. However, the first approach cannot be brushed aside either. Visa Office can consider three tools: (1) Use of unused immigrant visa numbers from other immigration programs and other countries. Currently, ROW consumption of the EB visa numbers are so low and some of the numbers may go unused and wasted unless this option is considered. (2) Recapture of past unused immigrant visa numbers. (3) Open up FY 2015 EB immigrant visa numbers to Current or allocate the balance of FY 2015 quota numbers before the 4th Quarter of the year, which will end up exhaustion of EB visa numbers earlier than the end of the fiscal year (09/30/2015) and the number may become Unavailable for a couple of months. As for the (3) approach, Oppenheim already indicated that India EB-2 numbers may slow down or move backward during the last two month, August and September, after continuing move-forward (?) of the cut-off dates in June and July. Oppenheim has a power to decide how to allocate the visa numbers during a year but for the FAM. FAM is not a rule and just like a policy manual or memorandum for DOS. This can be changed without rule-making process. We want to see how these tools may be used by the Visa Bureau in June 2015 Visa Bulletin as part of implementation of the President Obama's promise to reform Visa Bulletin management process. ala rule making processes antee malli oka nearly 2 years aaaaa like H4 EAD
