Usually judges think objectively based on evidence presented by both accusers lawyer and prosecutor, instead of emotional decisions. The convict can appeal make that argument that there was prejudice in the judgement and transfer to another court (like in Jayalalitha's case). In this case he appealed many times from starting of the trail to now. So we have to assume that whole system is against the person. The opposition to death penalty is mainly to avoid executing an innocent person hastily (like one case happened in Texas).
