Is anyone good enough for h1b

My lawyer friend had her H1 approved recently. Her job duties were related to her field. No questions asked. With her MBA she could have applied as a manager and quite a lot of MBAs do get approval when they apply as general managers/finance managers etc. Their job duties are related to their field of work and the process is much simpler.  She quite clearly was trying to get through the back route in the IT field. Yes, many big companies were established by immigrants, but it has been taken advantage of too. May be a few of the highly talented guys make a difference, but a lot more people just use underhanded techniques to stay back. For every one Vinod Khosla there are thousands who have just misused the system. Did all these people complain when the system was being exploited? Nope. They are just throwing the toys out of the pram now that their cheese has moved. 

This is bullsh!t. You are talking about people who exploited the system to condemn the people who are doing everything in proper way. 

Don't worry. More and more people will cry now, even the ones who have been exploiting the system.

How is she doing things in a proper way? She has applied under the wrong speciality occupation and hence her RFE. Just because they went to good schools doesn’t mean that they can do no wrong. People are getting H1 approvals with an MBA and those guys have correct documentation. Let us not try to polish this over and say it is pristine. If everything was right with her application she wouldn’t have gotten a rejection. The system did not go out of the way to reject her.

lol..That's the end of discussion. People get H1s because they have proper documentation? Is that the criteria? Isn't that why people are faking and manipulating all documents and getting H1s approved even though they do not meet requirements? Isn't this enough to say the system is not working. I am not going to argue with people who think system is still working as expected. So, lets leave it here.

So you mean to say that even though she doesn’t have the correct documentation and even though she isn’t qualified for the job she applied for, they should let her get an H1? Maybe there are people faking documentation but that doesn’t apply to her case. If she is so perfect, she would have satisfied the criterion for an h1 approval. The abuse done by the so called ‘good guys’ in your mind is okay. Yeah right.

There is never an abuse by good guys. period. First try to think and figure out whether you are talking about system or just her. I am talking about system.

lol..by faking documents? 

H1 system doesn't differentiate competent fellow from incompetent fellow. It didn't have to because number of petitions are far fewer than available slots before. But it is not the case any more. They need to find a way to find the best 80K petitions out of 200K petitions. Until they do that, I consider this a broken system. Not just me, graduates like her and every sincere/hard working/ethical person thinks this way.
