Cognizant Technology Solutions Corp, the biggest US sponsor of H-1B visas for foreign information technology specialists, says a civil rights lawsuit accusing the firm of bias against workers who aren’t from India is all wrong.

Three former employees claim they were forced out of their jobs and replaced with “less qualified” South Asians after being poorly treated by their Indian supervisors and colleagues, given unjustifiably low performance ratings and denied promotions.

The company contends that what it’s accused of isn’t covered by federal civil rights law.

The Civil Rights Act of 1964 “prohibits discrimination on the basis of race, but plaintiffs’ factual allegations, on their face, plainly pertain to a claim of discrimination based on national origin -- not race,” Cognizant said in a court filing. It also said the complaint is clearly targeted at “visa holders, but visa-status allegations have nothing to do with race.”


BROADER BACKLASH

The lawsuit is part of a broader backlash by white IT workers against the visa program that allows US companies to bring in foreign workers for job openings they say can’t be filled otherwise. President Donald Trump tapped into this discontentment to capture the White House in 2016.
Trump’s “Buy American and Hire American” + executive order, signed last April, seeks to ensure that American workers aren’t unfairly disadvantaged by employers who allegedly abuse the H-1B visa program.
 
 
 

US District Judge Dolly Gee in Los Angeles said Thursday she would rule on Cognizant’s request to dismiss the claims without a hearing.

Cognizant received 29,000 H1-B visas last year, according to Homeland Security Department data, about twice as much as Tata Consultancy Services Ltd., second on the list. The biggest US technology companies, such as Amazon.com Inc., Microsoft Corp., and Google Inc., are much further down the list with fewer than 5,000 sponsored visas each.

TCS may have to face a class-action trial later this year in Oakland, California, by American workers who claim they lost their jobs because the company is biased in favor of South Asian IT employees. The same Washington law firm representing the workers from TCS and Cognizant is pressing similar claims against Infosys Ltd. and Wipro Ltd., two other IT outsourcing firms.
 


TCS, Infosys and Wipro are all based in India. Cognizant’s headquarters is in Teaneck, New Jersey.

This is nothing new... When Indian Managers favor people on the basis of caste, region and language even here in India, they just carry this rouge practice there as well... The middle level mgmt is pathetic in all these sweat shops viz CTS, TSC, Infy, Wipro, Accenture etc.. Forget about showing partisan on already working people, they''re even biased during interviews... If a candidate from different language/region performs well during the interviews, he is just discarded saying "too much attitude".... ... Read More

Product based companies are far better.... .... Off my 10 years of experience in software development, I''ve spent 8 years in two product companies and just 2-2.5 yrs in 3 service based ones.... ........ ....... I''ve seen such behaviors in service based sweat shops.......... ....... ..... Not just managers, even the tech leads and architects are scared to recruit candidates who are better than them.... .... Take my word, these highly biased sweat shops are gonna suffer even more in the coming times, smaller product based startups are already giving them a run for their money...

Indians don’t deserve to be managers. When we do become managers, we feel like we are Gods and we own everyone below us. Since it’s difficult to control white workers, we replace them all with easy to control Indian workers.

We always talk about being victim of Racism/Casteism but reality check is that most Indians are Sexist/Castist/Racist, South Indians hate North Indians, Tamils hate Malayalis vice versa, North East folks are called Chinks and considered as Non Indians. We are Indians on on Passport or when India plays Pakistan or 15 Aug 7 26 Jan

We do not integrate well with foreigners; MNCs which operate in India have a very different work culture and ethics compared to our 100% Indian IT companies. We have a nasty superiority complex which is as bad inferiority complex. I am aware of management practices of some of these IT companies which is not based on mutual trust and respect but on hierarchy based power. In fact one of the much respected leader of one such company had extremely poor opinion about foreign/expat technology managers. If Indian companies have to become true MNCs like Sony, Siemens, SAP....we need to re-orient how we interact with rest of the world. No complexes, inferior or superior. Also, yes how about starting to treat people from other States well. If you doubt, go to any MNC office in Kolkatta or Chennai and compare it with an office in Bangalore!

Indians need better training...not technical skills but etiquette skills, leadership skills, presentation and behaviour skills and need to come out of the mindset that we are good at IT and we form backbone of outsourcing. The reality is that there are better coders than us and we need to present competetion front door, not back door.

Integrate with other communities ...haha..it has never happened in the past 3000 years of civilization.

Indian work ethics are different to other countries. This is due to the immense competition due to large population. However, in developed countries, people like to have balance in personal and work life. They need weekends, they would work for 8 hours, they need not go and suck up to their bosses, etc. Of course, there are exemptions. However, companies like Cognizant, TCS, etc., expect Indian work ethics from non-Indians. This will fail miserably.

So much of hate spewing... what will you get from this sadism @tennisluvr.. just remember these are the same guys with families. they may not be as meritorious as you expect  but they came to US because US trapped their minds showing a better life .. I am not speaking because of any interests but the eerie feeling the we are the "Juice" of "Prapancha yuddham rendu" is creeping in because of supporters like you...

8 years ago I used to make a living driving an auto and selling pani puris part time while pursuing my BCA distance education. I also took up english classes, linux administration, databases, automation testing, and python. Today Iam in the USA working for a multibillion dollar company, holding a green card, own two houses, a Maserati, BMW 6 series, and make USD 250K a year in salary alone. I hold hundreds of bitcoins and thousands of ethereum, dash, litecoin and other cryptocoins that bought 3-4 years ago for peanuts. The trick is to avoid social media, TV, parties instead catch a trend and work hard and take your parents blessings. The trend for the next 2 decades is Artificial Intelligence. I have spend countless hours learning AI and implementing a variety of AI based solutions. In the next year I am planning to set up my own AI based products/services company and help create jobs for hundreds of thousands if not millions of talented Indians
