ap1234 Posted March 19, 2018 Report Posted March 19, 2018 My Initial H1B approved in 2012-Aug and i got approvals from 2012-2015 and 2015-2018 under Masters CAP(Stratford University) and i got denied this year as my initial H1B was approved in error and My attorney suggested me to apply in Bachelors cap this year and maintain a Legal status such as H4 or go out of country and come back. But all of sudden my attorney saying that i'm not eligible to apply in "Bachelors cap" i need to go out of country for 1 year to eligible to apply new cap petition. I have approved I-140 and i used only 5 years 4 months of H1B can i be eligible to apply new cap without going out of country for 1 year ? Quote

If you haven't used all of ur 6years of h1 you will be eligible for cap. But ne scenario lo h1 denied antunnav kada i dont know about this case. if you have an opportunity change to h4 for time being until u sort things Quote
