I applied for extension on feb 5 th and got speciality occupation rfe on 7 th feb . Had email conversation with Manager but didn’t had client letter as federal client . EVVC , MS in CS , Level 2 wage and SOC code 15-1132 . Designation in company Senior Application Developer and client designation Application Tech Lead . Query was to justify why that position need a degree in computer science and how it qualifies for speciality occupation. 

We cannot get a single document from client so I insisted to file new petition and not answer that RFE. My employer was resisting for new petition but I had a rough argument and asked him to file new petition as I do not have i94 validity to open MTR  if my application is denied .

 Lawyer said there is risk involved in answering speciality occupation but can go with new petition if I insist . Fortunately query time lo client name changed with acquisition so material change kuda petti filed new petition . Actually this route is not needed as lca lo client name undadu so not really material change but new petition Kosam new lca chesam . I took risk regardless though lawyer said previous petition mida question ravachu why we didn’t answer rfe ani but went ahead as I thought i94 validity lekunda denial would be more trouble .  Same documents malla pettamu. Applied on 25 th April approved today  in Vermont center . Just posting as it will be helpful for people who are going through same situation.  New petition is not a bad idea instead of answering rfe if you are ready to pay twice . I went ahead this route as query padi answer chesina vallavi 3 denials ayyayi in my close circle . 

Update : Approved for 3 years . Just got email from lawyer . 

I have to say you are a bit foolish to file second petition...general ga neeku first rfe ki answer enduk cheyale ani inko query ostunde kotha petition meeda it happened to some people .....general ga lawyers dont suggest ...lucky ga approve ayindi anyway congrats

I had material change and going for stamping  end of month . Old client name to can’t go as type of contract nunchi location kuda changed and I work 100% remote . I needed a new petition. Lawyer said I need amendment if I answer that query and in case gets approved to go for stamping . Also working for federal client you don’t get a single document including email . Lawyer to anni options discuss chesaka went that route .Thanks though .

nope its not mad,  one need to have different kind of mindset based on the situation they are in, instead of asking friends about what to do, one can simply go by their instincts aka gut feeling.. that works most of the time..i guess its the same here
