05/11/2018: Trump Administration Plans to Push Ahead H-1B Program Reform in General with Changes of Definitions of "Specialty" Occupation and "Employer-Employee" Relationship

  • Along with the H-1B Annual Cap reform, Trump Administration plans to push ahead reform of H-1B program by changing requirements for "Specialty Occupation" which is a threshold requirement for H-1B nonimmigrant program to focus on obtaining the "Best and Brightest" foreign workers. They also intend to define the employer-employee threshold requirement, further narrowly defining the standards.
  • This reform has been somewaht delayed after the President Trump took office, but they plan to push ahear early next year, as early as January 2019. Remember that this reform is likely also to apply to the current high-tech workers who are in H-1B status and need extension or amendment in the future. Beware!

05/11/2018: Trump Administration Plans to Reform H-1B Cap Selection Rule Coming Years Selecting Based on the Most-Skilled or Highest-Paid Beneficiaries

  • President issued Executive Order earlier of "Buy American, Hire American" which has been implementing step-by-step. Section 5 (b) ordered the DHS to reform annual H-1B cap selection criteria from current computer random lottery selection process to the criteria of "the Most-Skilled or Highest-Paid Beneficiaries." Trump Administration want to push for this reform and probably implement beginning from next year. USCIS is likely to initiate this reform around July 2018 by proposing rule changes for H-1B cap selection. Employrs, beware. Change is coming.
  • FY-2019 H-1B cap record reflects that even without this change, employers have been focusing on U.S. Master or Higher degree foreigners. More than 50% of total H-1B cap applicants in this cap season are foreigners with degrees of Master or other Advanced Professional education from high learning institutions (universities) in the United States! High tech foreign workers, beware! Change is coming! Possession of a simple Bachelor's degree will be phased out unless you are a genius who deserve one of the highest wages in the industry in this country.

Non-IT vallu will qualify for Spl Occ most of the cases (desi batch)

Its pure bias man. My friend with Civil Engg in Masters, he got three years working for American prime vendor. Same degree desi employer asking justification on education and specialty occupation.
