I am a Lawful Permanent Resident and when I came back from a trip outside of the United States, immigration officers took my green card, what do I do now?

This is a scary and surprising fact pattern that all to many green card holders find themselves in after a short or long trip outside of the country. No matter how long you have had your green card and how many times you have traveled outside the country in the past, on any given return trip, U.S. Customs and Border Protection (CBP) Officers can stop you at the air or sea port, take your green card and try to deport you

At our office, we have seen several signs that one of the Trump Team’s focus is employment based immigration.  The DHS has ramped up scrutiny of work visas and green cards through employer sponsorship.

We attended a naturalization interview recently with a client who came to America on an H1b, obtained a work based green card and then started his own information technology (IT) consulting company.

The N-400 interview included a whole lot of questions about our client’s work-based immigration history. The officer was extremely interested in whether our client and the companies that he worked for had complied with all of the rules regarding employment based cases.

SUPREME COURT RULES IMMIGRANTS CAN BE DETAINED INDEFINITELY WITHOUT BOND HEARINGS

After reaching a 4-4 deadlock on the issue last year, the justices ruled 5-3 against a group of immigrants protesting detentions averaging 13 months. They ruled on the law rather than the Constitution, which could give the challengers another chance to win their case in lower courts.

Thousands of immigrants facing possible deportation are held for a year or longer before getting a hearing, including lawful permanent residents and people seeking asylum.
