Petition has nothing to do with I-94, petition shows you are legal to work and I-94 is your legal stay. Vaadu petition with draw cheskunna you can stay I think but cannot work for anybody endhuku ante kottha petition denied and paathadhi withdrawn kada. I may be wrong but as per my understanding aithe idhe, evaranna employer ni vethukkuni H1 cheyyamanu premium lo

He is out status even tough his I94 is active .

Having an unexpired I-94 does not keep you "in status." What you read is absolutely wrong.

Based on the information you have provided, unless you never left the H-1B employer you were already authorized to work for, and you kept working for that employer, you are no longer in status. If you left your former H-1B employer and went to work for this new employer, whose H-1B petition for you just got denied, then you are no longer maintaining your H-1B status and you have no legal right to be in the United States.

best option i guess would be to stay in the US for few days and ask you employer  to file a new H1b in premium immediately .
