Office of the CIS Ombudsman

Teleconference on USCIS Policy Updates on the Issuance of RFEs and NOIDs

Dear Stakeholder,

On September 6, 2018, from 2:00pm to 3:00pm EDT, the Office of the Citizenship and Immigration Services Ombudsman will host a teleconference to discuss U.S. Citizenship and Immigration Services’ Policy Memorandum on “Issuance of Certain RFEs and NOIDs.”

The policy memorandum gives adjudicators discretion to deny an application, petition, or request without first issuing a Request for Evidence (RFE) or Notice of Intent to Deny (NOID) if the initial evidence does not establish eligibility for the requested immigration benefit.  Historically, USCIS adjudicators followed a 2013 policy memorandum titled, “Requests for Evidence and Notices of Intent to Deny,” which encouraged the issuance of RFEs and NOIDs when the initial evidence submitted did not establish eligibility.  The new policy, which goes into effect on September 11, 2018, rescinds that guidance.  The new policy applies to all applications, petitions, and requests, except for Deferred Action for Childhood Arrivals (DACA) adjudications, received after September 11, 2018.

The CIS Ombudsman invites stakeholders to join our office and USCIS officials to discuss implementation of the new policy guidance.  We will reserve a portion of the teleconference to hear concerns and questions about the new policy’s potential impact on stakeholders and how this guidance will be used with other recent policy memoranda.

We invite the public to register for this important teleconference using the link below.
