Wage and Hour Department in the State of Rhode Island had begun a preliminary investigation into the possibility that Infosys is filing for H1-B visas under the ‘exempt salaried’ category while using the employees as non-exempt hourly workers.

An exempt visa issuance requires the company to comply with fewer non-displacement and recruitment obligations.

“The Wage and Hour Division of the Department of Labor is looking into the matter of incorrect listings of employees,”

Yes, this seems to be the only point in the case with some merit.
