Is your i140 approved morethan 180 days old?

Then change employers as you needed. Even i140 is withdrawn by your current employer after 180 days your new employer is eligible to apply extension without another i140 processing.

yes, its not new. But, many dont know about this employers change from A to B and C possible and apply extensions without another I140 processing.

 

Even they knew this many are waiting with same employer for their priority date to come which never possible with current GC system.

So how does it work - Thought process as any other Contractor on H 1 B.

  1. I have approved H 1 B+ i 14 0 with Emp A (Contractor)
  2. After 180 days - I transfer my H 1 B to Emp B (Full Time) - Premium (15 days) - Normal (6 months)
  3. I get the receipt from USCIS & I start working for Emp B
  4. Emp B will file PERM ( Ads + Cooling off + Filing) - 8 months - What if my PD becomes current at this point (i Know its long wait)?
  5. Do we need to reapply 140 here or what is the process after this?

Come back to ur older employer if u want to be inline

when dates are current to claim GC yes you do need new I140 with your new emploer B.

But, you should know to cross 2010 in EB2 or EB3 it would take another 5+ years.

 

While attending a recent conference, Mr. Oppenheim also provided a more long-term prediction for the EB2 India category. Based on the number of pending I-485s in this category, he expects it to take about five years to process all of the EB2 India cases with priority dates that are earlier than January 2011. Therefore, regardless of how quickly the EB2 India category advances in the short-term, it appears that Indians with priority dates of January 2011 and later have quite a wait ahead of them.

2. Employer B - Transfer pettukoni move avvachu ... 1/2/3 years Approve avutundi .... 

3. Employer B - Next Extension lopu he has to complete the PERM and I140 again ... You can use your previous employer PD

3 is not required. you can go to 4 also.

Ardam kaledu bro... Nenu cheppina dantlo 3rd point correct aa kaada ani cheppu ... should the new employer file PERM and I140 (but can use previous PD ) before you file for extension ...
