1. Trifurcation does need J&K assembly, look at how AP was divided. Legally only parliament is needed.

2. 35A was brought in as Presidential order. It never had the approval of parliament. Meaning, it NEVER had official sanction of parliament. Removing it CAN be done through order BUT it will end up in courts. Wonder if current SC judges have the balls to oppose govt on this issue? I doubt it

3. Article 370 was always meant to be a temporary provision that came into being through J&K constituent assembly BUT J&K has not had a constituent assembly in over 70 years. Meaning. removal can be done through Presidential order/Parliament BUT again it will end up in courts. No SC Judge will have the balls to oppose the govt on this again.

 

Out of all 3, the cleanest would be trifurcation, it needs only parliament approval. Once the state is trifurcated, 35A and 370 would cease to exist or would not matter anymore.

Oh I whole-hardheartedly agree that SC is a bastion of scroundrels

BUT

these are scoundrels and not fools. They know which ones they can touch and which ones they can't.

And more importantly these SC AHoles can do their politics when executive is weak.

 

Right now the current govt has the CJI by his balls - literally.
