I heard it's up to them to decide Whether to apply the spill over or not. It's not mandatory that they must apply according to law. Someone told me this. Not sure if that is true.

Thank you for contacting me to express your support for the Healthcare Workforce Resilience Act.  Your opinion is very important to me, and I appreciate the opportunity to respond to you on this critical issue.

 

The Healthcare Workforce Resilience Act would allow nurses with approved immigrant visas to enter the U.S. and would allow physicians with approved immigrant petitions to adjust their status.  Under the bill, U.S. Citizenship and Immigration Services (USCIS) would “recapture” up to 25,000 immigrant visas for nurses and 15,000 immigrant visas for physicians drawn from the pool of unused employment-based visas Congress previously authorized. USCIS would also recapture immigrant visas for the families of these medical professionals.  All immigrant medical professionals receiving consideration under this bill would be required to meet licensing requirements, pay required filing fees, and clear rigorous national security and criminal history background checks before they can receive recaptured green cards.  Employers of immigrant medical professionals who receive consideration under this bill and who would arrive from overseas will be required to attest that the immigrant medical professional has not displaced and will not displace a United States worker.

 

I share your interest in creating a workable employment-based visa program, and I was proud to be a part of the bipartisan group of Senators who introduced comprehensive immigration reform in the 113th Congress.  S. 744 would have established an improved process for employment-based visas, including significantly more employment visas through recapture of unused visas, elimination of the per-country caps on employment-based visas, and elimination of the current employment visa backlog.  The bill also would have exempted graduates from the Sciences, Technology, Engineering, and Mathematics (STEM), among other highly skilled professionals, from the employment visa cap.  The Healthcare Workforce Resilience Act was introduced by a bipartisan group of Senators in the Senate and was referred to the Judiciary Committee.  Although I am not a member of this Committee, please rest assured that I will keep your views in mind as I review this legislation.
