Guys,

My wife is on H4 EAD and her work is reduced to 3 weeks till Sep month end. She is full time. His manager is saying she can claim for one week unemployment benefits. Is she eligible ? Is it come under public charge ?

Do you know why she is not eligible. State saying even you are not citizen and if you have work authorization you are eligible for unemployment benefits

Your employer pays to the insurance company for unemployment benefits. It is like claiming insurance benefit. Below is from the USCIS website.

 

B. Public Benefits Not Considered

1. Unenumerated Public Benefits

The following is a non-exhaustive list of public benefits that USCIS does not consider in the public charge inadmissibility determination as they are considered earned benefits:[20]

  • Federal Old-Age, Survivors, and Disability Insurance Social Security benefits (SSDI);

  • Social Security;

  • Veteran’s benefits including but not limited to HUD-VASH, and medical treatment through the Veteran’s Health Administration;

  • Government (including federal and state) pension benefits and healthcare;

  • Unemployment benefits;

  • Worker’s compensation;

  • Medicare; or

  • Federal and state disability insurance.

Claim if you what. Stay away if you want to be on safe side. Just not worth the risk for that money

I have decided to go with that. 15 years nundi ee uscis ki bhaya padi sagam jeevitham ayyipoyindi. Vaadu green card ichchindi ledhu sachindi ledhu. Sagam jeevitham ayyipoyindhi veedi extensions / rfe la thoane....H1b are only have 2 months grace period and they cant access any unemployment benefits but employment cards dont have any restrictions to apply unemployment benefits.

She can apply for benefits even if you have reduced number of hours of work. She is hourly paid and her hours are reduced.

Does yours or your spouse's SSN has valid for work only with DHS authorization?

if no.. then try applying ... your GC will be definitely REJECTED.

If YES.. then better stay away from that thought of getting govt handouts.....

Conditional GC individual ki kuda dhs authorization for work vuntundi as for as I know.....

Only GC/us citizens ki  dhs authorization Ani ssn meeda vundadu .. adi ssn meeda nunchi teyinchadaniki GC tesukoni ssn office ki vellali
