Because of covid they already gave 60 days extra time to respond for rfe and noid on top of regular timelines. I doubt if they can enforce this unless they can relax that extra 60 days rule.

Taking a step back, this will actually turn against USCIS if they issue NIOD because missing document cannot be NOID unless they suspect issue with submitted documents.
