485 (GC), Ead , AP, Spillover issues

@csrcsrbro and experts:

quick question on my scenario:

my 485 along with spouse will be filed soon (with Medicals) pd: eb2 2011 jan 

spouse currently on H4 ead (expiring tmrw). company applied fresh h1 (non-profit) last week in pp (awaiting response)

question: if she gets h1 approved and starts working on h1, does her derivative 485 gets denied? and does she have to convert back to H4 to get her on my 485?

if h1 gets approved, but she won’t work on h1, wait for H4 EAD… does this work or Do we have to call uscis right away to stop h1 processing?

 Please  help with ur inputs tiy

Once her H1 approves , her status will be changed from H4 to H1. At, any point you can't have both H1 and H4 .

485 has no impact if she moves to H1.

bayya, but we mention in 485 application that she is a dependent right? Don’t u think it will impact when she gets her own h1 and starts working ? Leaving dependency as H4 and EAD? 
just curious bayya, don’t wanna mess up things as we are waiting for this GC for so many years by doing a simple mistake.

we would rather leave job and wait for H4 EAD if this new h1 impacts any

Nothing will happen if she gets h1 she can continue to work no issues to derivative application

Yiu don't mention as dependent , she is derivative to you that doesn't mean she needs to be onh4 bro emi kaadu she can go on h1

485 is future. No issues.

Who spoiled you with this crazy doubt? Clear ga undi kada. Your current status only important for what you do. 485 is based of future employment and since she is your spouse you are sponsoring her. Indirectly future employment.
