There is a reason that I had to call you out as either mentally retarded or plainly ignorant. It seems to be both.

Health is a subject of the state for the simple reason that the Constitution per schedule vii has vested the law making power to the states. And union government role is to suggest welfare schemes only. If at all the health was part of the concurrent list in the constitution then the union government would have a say in directing the state on the laws pertaining to health. It is because of this structure although welfare schemes such as Ayushman Bharath were made available by the central government, state governments in Telangana and Odisha rejected them being the final authority. 
 

now coming to the oxygen procurement, the states don’t have that authority and that doesn’t in anyway is challenging their law making authority pertaining to health.
