appudu unna mental state ki signed… tharvatha one may not like the work culture and so free to resign siting mental pressure and work life balance. US law protects employees.

One thing to note though, that person should resign professionally giving enough notice and KT etc…

Better to negotiate with the employer 

Employer can file a couple of forms at the local court and get an immediate cease order. Your friend has to stop working until the issue is resolved, meanwhile he will lose his job and status both. TCS used this tactic with a couple of their employees that took FT with the client and finally the employees had to return back to TCS payroll..

That is the stupidest thing he can do..  Companies don't want to get involved into legal things for just one employee, as a matter of fact it might back fire on your friend

Ela cheste client feel itadu kada.. na direct emp ni lakkunarani.. Will thy spoil that relationship for just 1 emp?

Exact clause theilkunda comment cheyyalemu bro.. if he has the offer letter in his... post the exact lines as it is here then i can help you on that... 

Remember this 

if the employer does not have a legitimate business interest in preventing the employee from working for a competitor, then the non-compete agreement can be successfully challenged.

Burden Employe paina untadi his employer has to prove to the court that his business interests were lost , which is never going to happen.. if there is a middleman involved then the employer is s***in his own d**k.

Non compete clause have no legal validity unless you are paid for the time period .

Most Companies pay 60 to 90 days severance pay during departure , so you are technically still employed. 

Unless you have received payment for the time period , non compete clause cannot be enforced anywhere in USA.

They have to pay the half salary for the period under loss of wages... also the employee is free to work for another employer....
