Latest USCIS Info on Interfiles and Standalone AOS Applications

The American Immigration Lawyers Association (AILA) has recently provided a practice alert to its members with some helpful information regarding the status of interfile requests to transfer the underlying basis of an EB-3 adjustment of status application to EB-2 based on a prior I-140 approval. USCIS has received approximately 13,000 interfile requests in the last 3 weeks. USCIS reports that it has been able to issue I-485J receipt notices for the majority of these requests. So those that have submitted interfile requests recently should have received receipt notices or should expect to receive them soon.

As previously reported, during a stakeholder engagement with the CIS Ombudsman, USICS had indicated that AOS applications filed in April 2022 would likely be able to be adjudicated by the end of this fiscal year, September 30, 2022. In further welcome news, AILA reports that USCIS even expects to be able to adjudicate employment-based AOS cases filed by early June 2022 before the end of the fiscal year in September.

Lastly, many applicants who have interfiled have been reporting that their online case status shows that USCIS is “temporarily pausing work on your application because an immigrant visa number is not immediately available to you” even though USCIS has already issued a receipt notice for the I-485J submitted requesting that the underlying basis be transferred to EB-2. AILA has learned that this case status update only reflects the “last adjudicatory action” taken by an officer. The case status will not be updated to reflect that an interfile request has been received. The case status will not update again until the interfile request has actually been adjudicated.
