if you go after transfer is approved you wil get kotha i797 along with i94, i9 update to new employer 1 day task bro it will be done, kotha employer 2 weeks permission isthey go to India while coming back just show new i797 copy thats it, you are set.

Ex: if you get H1b approved before you come back from India, then i94 you get at POE will take precedence over what you had in your i797 approval copy of H1 transfer

 

what if he decides to not to join the new job after h1b approval with the new employer, he can stay with old employer right?, in that case why can't he travel to India with old employer H1 which is valid till and he is not yet joined new company even though new companys h1 is approved?

yeah even though H1 transfer is approved with new employer, we can still continue with old emp and simply deny new job offer after transfer is approved. So I guess we can still travel and come back with old I797 and existing visa stamp.

Kakapothe oka catch, new transferred 797 lo next 3yrs ki H1 isthadu...so return POE lo I-94 end date will be 3yrs from now and not necessarily based off visa stamp expiry date. All these are purely based on CBP officer anuko, but this is one case
