H4 EAD news April 19, 2018 – In a letter to 15 US lawmakers, USCIS chief Francis Cissna indicated that the new administration wants to revoke H4 EAD work permits for more than 100,000 spouses of H1B visa holders. When lawmakers requested the new administration to reconsider its plan to revoke H4 EAD, Cissna responded with a crisp one-pager. A careful reading of the USCIS response – “the public will be given an opportunity to provide feedback during a notice and comment period” suggests the time for revoking H4 work permits is close.

Any proposed rule has 60 days notice period for comment. With the midterm, elections closing in anti immigration stand continue to become stronger. However, Cissna equated the policy tilt in the wider arc of “growing the US economy and creating jobs for US workers”. In addition, he adds that Trump’s Buy American, Hire American executive order makes it imperative for the DHS “to propose new rules and issue new guidance to supersede previous rules.  Although Cissna has not mentioned any specifics on the fate of the H4 EAD, the language and tone of his letter leaves very little room even for H4 EAD optimists. Under the Buy American, Hire American executive order, proving that immigrants are hurting Americans in the job market is the first step to creating the basement for any rule change. And we already know that “H4 EAD economic analysis” is already underway.
