Concept of ‘open ballot’ system during the election to Rajya Sabha

  • Rule 39AA of the Conduct of Election Rules of 1961 provides for open ballot system.
  • A voter may show his/her marked ballot paper to the authorised representative of his/her political party before dropping it into the ballot box.

Bro...You are understanding the rule wrong... It is only invalid if the procedure is not followed like -

Not showing to the authorized representative

Not marking their choice of candidates by ranking them

Or incomplete ballot or using some other stationary to mark them rather than the one given by EC

 

BUT they can always follow the guidelines like above points and still vote for any candidate they wish.. It will be valid... but the party because of the WHIP can take action on them asking the speaker to disqualify them.

With that they can ask for disqualification..but avi ayye pani kadu ..
