You can do it. That's shouldn't be a problem. But on what grounds do you think you can sue him? American employers are free to fire 'at will'. Did he withheld your severance package or wages? Do you have any unpaid bonus or stock options, that are not discretionary? Were you discriminated?

You can't sue him. Employment in US is at will and they can hire you or fire you at any time.. 

Ee revenge dramas kante find another project and transfer your H1 and go back to US..

if you have a valid visa.. Look for new employer and fly..

It would be a long/ Tough fight if outside USA and fight against someone in US..
