H4 - EAD cancel anta..

Dear Friends, 

On Friday June 23rd 2017, the United States Court of Appeals for the District of Columbia granted DHS's Motion to put proceedings in Abeyance until September 2017 while deferring consideration of our Motion to Intervene. 

We view this as a victory since the court rarely grants motions to intervene and by explicitly not dismissing our Motion, seems to have the same concerns about DHS's intentions as we do. 

By deferring consideration of our Motion to intervene, the court has kept open the option of granting our Motion to Intervene, if DHS attempts to stop defending (or even attacks) the H4-EAD regulation in court. 

We believe, if it weren't for our Motion to intervene, everyone currently working on the H4-EAD work permit would suddenly have lost the ability to work on April 3rd 2017. 

Currently because of our intervention, we know that our members who rely on the H4-EAD to work, will be able to continue working at least until September 2017 and think it might take another 6 months beyond September 2017 for a contravening regulation (if any) to be finalized.

"DHS was due to file an update on the progress of it’s policy assessment by end of first week of June 2017. No filing has made on record as on date"

Writing a regulation is a long process - but we think they will get around to it sooner or later.

Yes. Probably matter of 6 months to 1 year.

Better have a backup options available. like moving to H1 etc.
