By deferring consideration of our Motion to intervene, the court has kept open the option of granting our Motion to Intervene, if DHS attempts to stop defending (or even attacks) the H4-EAD regulation in court. We believe, if it weren't for our Motion to intervene, everyone currently working on the H4-EAD work permit would suddenly have lost the ability to work on April 3rd 2017. Currently because of our intervention, we know that our members who rely on the H4-EAD to work, will be able to continue working at least until September 2017 and think it might take another 6 months beyond September 2017 for a contravening regulation (if any) to be finalized.
