desiboys Posted November 28, 2017 Report Share Posted November 28, 2017 OMB has announced that the Trump Administration will revise and release revised SOC system with many recommended changes modified occupations’ titles and definitions to appropriately reflect technological advancements within the occupations. Significant recommended updates were recommended in the management, business, finance, information technology, engineering, social science, education, media, healthcare, personal care, extraction, and transportation occupations. Obviously, this change will lead to change of the specific codes of the current DOL SOC down the road some time late this year or so. No details are available yet, but this change will definitely affect the employment-based immigration system and process, including H-1B and PERM down the road. The latest change brought about a dramatic change in codes. For instance, it down graded Software Engineer Occupations into Software Developer Occupations, changing SVC 8 to SVC 7, making a less professional occupation, challenging the foreign labor certification process and system. For the reasons, in FY 2018 H-1B cap petitions, the Service Centers issued Request for Evidence (RFE) for the petitions for Software Engineer jobs asking to prove that this occupation is a specialty (professional) occupation, which is the threshold requirement for H-1B petitions. https://www.bls.gov/soc/2018/soc_responses.htm Quote Link to comment Share on other sites More sharing options...
