Cos from h1 to h4 ? While h1 extension is in process?

Frnds need ur suggestions on this

 

my wife h1 extension got rejected last yr oct , she applied again with other employer 

i94 is expired November 

now the h1 extension and amendment is in process 

 

recently we came to know she is pregnant... 

we might have to apply h4 after 6 months 

 

now what can she do ? Wait for h1 approval? Or apply h4 

As i94 is already expired does she has to go for stamping if h4 is approved?

plse help

your best bet is to send her out of country and come back on h4 visa as it is easy to get h4 visa and in quick way.

if your wife new h1 gets denied  by any chance, then she will be considered as out of status from November.

consult a lawyer to get more clarity on what to do..
