I worked for Previous employer for 10 years plus till june 2020 .EB2 I 140 approved PD dec 2013 2.I moved to current employer in june 2020 . Perm started but moving slow pace As many if you know In October 2020 dates became current for My Prority date. I have choice to apply downgrade. I thought dates retrogress soon, so I have asked previous employer to file my downgrade. He agreed and filed , he applied 131,485,485j , 765, 140 downgrade. I 140 approved and waiting for EAD from SRC. I have asked my current employer immigration can you transfer EB3 downgrade using AC21. Current employer immigration department sent me email saying actions took by your previous employer filing I-140 was misrepresented because you are working for us. This could result in I-140 denied or revoked Or AC21 revoked.They said we will not tranfer using AC21 and on top of that they brought new issue. I’m worried current empoyer making it big issue and I may loose Job on this . So I was thinking anybody give advise before meeting with my immigration department.
