Useful info for eb2 to eb3 downgraders

1) New perm, i140 and i485 required if you changed employer. 

2) If same employer only i140 and i485. No perm. 

3) In either case eb2 priority date is retained. 

4) No premium is available for downgrade. 

5) Employee can pay his own fees and lawyer fees legally and employer needs to just sign on the petition documents since it needs employer. 

6) Even if your eb3 is denied, eb2 status is unaffected.

Once downgraded to eb3 is it easy to upgrade again to eb2?

most of the attorneys are pushing the companies (full time) to revoke them the Eb2 140, if EB3 is filed.

so that they can make money.

but if it is held and not revoked, u can use that one.

Premium is eligible. but u will not get result within 15 days.

thats what...considering the current rush and no original Perm form, they will take premium fee, but might not respond within 15 days.  a guarantee ivvadu.

Did Attorney send the confirmation.  Can you please explain with more details for 3 and 6 points

Now makes sense. Some where read his recommendation for downgrade is do if your EB2 date is current at EB3 final action date.

But indians use case is different to get EAD..

Nenu recent ga change ayya employer like one month ago.. ippudu old employer file cheyyacha eb2 to eb3 downgrade ?

final action date for EB3 is Jan, 2010 and filing date for EB3 is 01/01/2015. Ilanti use case lo EAD file cheyadam better no
