11/24/2014: Still Room for Employment-Based Immigrant Visa Reform Ahead Potentially Using Change to Annual Numerical Limit to Immigrant Visa Numbers and Recapture of Unused Visa Numbers Without Further Presidential Executive Actions

As one may understand it, the AILA leaders reported attended the President's announcement of his immigration executive action plans on 11/20/2014 and is better informed than outside consumers and other stakeholders. As the primary organization representing immigration practitioners, no one can brush aside that the AILA leaders must have provided its expertise for the executives in and outside of the White House in working out the final plans.
We appreciate that the AILA has shored some valuable information to the members relating to the two important issues which are very important for employment-based immigration stakeholders:
One of the President's plans included "Modernizing and Streamlining the U.S. Visa System." It is the AILAs understanding that issues whether family members should be counted or taken out in per country visa limitations and whether unused visa numbers can be recaptured will be included in this effort of Modernizing and Stremlining the U.S. Visa System.
It is the opinion of the AILA that those foreign workers with an approved I-140 who are unable to file EB-485 because of the visa number regression may be allowed to obtain the benefits of a pending adjustment EB-485 proceeding, including EAD, while waiting for the visa number availability. AILA estimates that this reform is expected to impact about 410,000 people. Apparently, the same reform item of Modernizing and Streamlining the U.S. Visa System" in the President's announced plans implicitly included consideration of this option as well.
The Considerations are likely to be developed by November 2015. Obviously, the timing will be a long wait for the foreign workers, but this report should give them at least a hope and a drop of water on their thirty mouths.
