u need to file as F1 only...since u were on it for more than 6 months..

 

so neeku a 3 months lo cut aina Medicare and FICA taxes vaps vastai...no worries..

 

edi ekakdanna define chesi unda bhayya...for those 3 months on H1,  we can claim the SSN and medicare during tax filing ani?

 

I know when we are in OPT/CPT we don't need to pay SSN & Medicare.

Normally H-1B visa holders need to meet the substantial presence test, because they can't meet the green card test.  There is an exception for your first year of holding an H-1B visa, you can make a first year election. The first year election means you choose to be taxed on worldwide income in that portion of the year (2012 for you) that you were actually in the US.   The prior time that you were present in the US under an F-1 visa do not count for or against you, so you qualify to make the first year election.

If you don't make the first year election, then you can file as dual status the first year and file as non-resident for the first 9 months, claiming 21(2) standard deduction for that portion of the year and file as a resident the last three months.  That means you file two returns, but file them together.

F-1 OPT and CPT are exempted from SSN and Medicare taxes.... under Treaty..

yaaaa telusu bhayya kani oct nunchi h1 status kadha so FICA vuntai emo ani doubt. we need to claim them separetly vere forms vuntai not regular 1040 forms.
