I can Nail this situation .. How ever its just purely based on my knowledge and don't take decisions based on my statements.. 

 

I understand your situation .. You can ask your FUTURE employer to file PERM. The month and year that they file your PERM is your priority date. Your Priority date can be carry forwarded only if I140 is approved with the PERM filed employer. Otherwise the PERM would go invalid.

 

Coming to your other question. Yes an employer can always file your I140 ,though employee is not part of the future organization. How ever, no employer takes a risk by doing that. Most of the employer would want to file I140 only if employee generates atleast 2 paystubs from them. What if you dont join your future organization after your 140 approval ? they might think that you would request for FOIA. So short answer, no one files I140 unless the employer is really good and they trust you.
