Spring Regulatory Agenda Re-Confirms Trumps Plans for Reform of H-4 EADs, H-1Bs, and OPT

The Spring Regulatory Agenda of the Trump Administration was recently published and re-confirms the earlier announced plans for reform, but with updated timelines.

Be aware that no changes are happening TODAY. These are just expected proposals for change that could happen in the future.

Here are the major proposals in the pipeline:

  • DHS plans a proposal to remove from its regulations certain H-4 spouses of H-1B nonimmigrants as a class of aliens eligible for employment authorization (in other words, they plan to propose a new regulation to undo the H-4 EAD regulation). Expect a proposed rule in JUNE 2018.  YOU CAN CONTINUE TO FILE H-4 EADs!
  • DHS plans to propose to establish an electronic registration program for cap-subject H-1B filings. This action is being considered because the demand for H-1B specialty occupation workers by U.S. companies has often exceeded the numerical limitation. (Proposal may be announced in JULY 2018, may attempt to get this in place for April 2019 filings)
  • DHS plans to propose a revision to the definition of specialty occupation to increase focus on obtaining the best and the brightest foreign nationals via the H-1B program, and revision of the definition of employment and employer-employee relationship to better protect U.S. workers and wages. Look for this proposal in JANUARY 2019 (unlikely to be in effect by April 2019).
  • ICE plans to propose a rule to improve protections of U.S. workers who may be negatively impacted by employment of nonimmigrant students on F and M visas. The rule is planned to be a comprehensive reform of practical trainingoptions intended to reduce fraud and abuse. Expect a proposal in OCTOBER 2018.
  • Also expect another fee increase to be announced in OCTOBER 2018.
