thats not true. You can use it irrespective of underlying EB category. Both are treated same.

Some thoughts on why straight filers are ahead in green card approval than downgraders of Oct -Nov 2020 has something to do in part with background check.

 

Adjucators have to make sure applicants background check is cleared befor they approve I-485.

So in general the background check has to be current in the preceding 180 days before adjucation.

 

But it is at the discretion of the officer as some may request a recheck even if the background check is even 90 days old.

 

Here is the problem

The biometric check-Fingers print check is usually completed in 2-3 days

 

The biographic checks-( FBI & TECS name check can take a minimum of 2-3 weeks to 6 months.. nothing in the control of USCIS itself.

The clearance has to come from around 26 federal agencies.

 

All downgraders, had to go through these checks again, thus adding delay.

 

In fact USCIS has a mechanism in place where if FBI check is pending for 180 days or more, the adjucating offers has to get special approval from NBC to approve while awaiting the check..

 

Some people get status of case was  updated to show finger prints taken messages after New card being produced message.

 

That’s because, the officer initiated a fingerprint print check just before approval which usually gets resuled in 24-48 hours. Hence the message and the to Case was approved.

There is no Movement for EB-3 this year.

Is all the SO Visa numbers went EB-2 only? In that case, people who moved to EB-3 485J got stuck long time.

The FY23 SO also goes to EB-2
