yeah i130 adi takes 8-12 minths

then file 765. 131 and 485

If this is the case why can't our eb people go with this scenario ? Don't say uscis can't count them. They won't listen they are just doing what gov says. Nothing in their hands just following orders. 

Manollu voluntary ga idhi chesthe I don't see any backlog in india as well with recent SO scenarios  wll continue 2-3 years as well. Best option kada law change cheytakunda yevanni bathiladakunda. Just 1 app ante vache SO lo current ayyina at least EB3 no wonder with low count apps in eb3. 1 app vs 3 apps masth difference vuntundhi.

Agreed but huge spill over will change game anna. Neeku 100K visa lu vachinappudu just primary count ki normal time la 2k-4K ki chala difference vuntadi. USCIS not responsible for non immigrants anna. Adhi manolla myth lawsuit vesthe yedho aithadi ani. They are fed and they are well protected from these bullchit lawsuits. Just lawyer vuncles minting from desperate people. Some organizations and attorneys want to see you in backlog forever otherwise how would they survive.

if dependent is in US then they cannot file before primary is approved and immediately after approved the dependent will no longer be in non immigrant visa like h4. so they will go out of status as they dont have a pending 485 application or some other visa.

this is my guess ante.

This will not work if applicant does it. instead, is USCIS chose to do it that way, just like how they encouraged everyone to file TUB's, it may work. But that legality will be questioned for sure and I dont know if its even ethical on USCIS' part to do that.
