I am trying to reach out my attorney but wanted to check if someone in same boat. my Pd is APr 2013

I joined comp B from comp A in 2020 Jan and filed my  i-140 under eb2 in May 2021 which is still in process.

In sep when my PD become current in final action date my comp filed one more i-140 under eb3 along with 485 AP EAD etc.

Considering the retro is it better to wait in eb3. If so, whether my petition eligible for EAD or not? considering 140 is not yet approved yet. or its better to upgrade eb2 i-140 to premium?

Your date is neither current in eb2 or eb3 now in final action dates. Think about your strategy once it becomes current in some catargory again.
