if you interfile or file new 485 under eb2 while eb3 485 is pending it will take many years as per attorneys 

What about the applicants who changed the job? are they eligible to interfile. I got below from telegram.

Interfile
--------
You can interfile either on H1 or EAD , Within same the Employer or at New Employer 
Provided you have passed AC21
   - 180days of Pending 485
   - I140 EB3 approved (Downgrade)
   - Same or Similiar Job
   - EB2 I140 180days from approved date
   - Both EB2 and EB3 I140 are filed with same EB2 PERM

I checked with my attorney on what if my PD (2013 July) becomes current in EB2 ani, I have EB3 downgrade 140 approved already, below is his response

  • You can file a new I-485 based on the EB2 approval. The EB3 is an additional approval and does not negate the EB2 approval.

Looks like each attorney is saying differently, I don't think USCIS will do due diligence and make our petition approved in EB2 or EB3 without filing new I485

No no you can file new 485 bro your attorney is correct my company policy is restricting it may many future employment letters istge valaki emina concer o nit sure trying for exceptions

Ika 2013 EB3 hopes poyinatte kada @csrcsr ninnati bulletin tho clouds clear ayipoyay, started looking at Eb2 dates inka, if Final action dates  EB2 for July 2013 vaste interfile, filing date vachina waste kada as I already have EAD on EB3.
