Actually it's the other way. DOL has some leniency when it comes to wages but 1 year extension is nowhere in the immigration law and USCIS/POTUS can't change the immigration law through rule making. Also in the second rule their definition of employer-employee relationship is in direct conflict with IRS and DOL interpretations, so the second rule is a lot easier to be struck down compared to DOL wage hikes..

Because that's how the immigration law was written and passed through the senate and house in the late 80s/early 90s..Any change to this term has to follow the same channel, not via rule making..
