bro  I think they can adjust the case if dates move in eb2 for nov or dec bulletin  if current eb2 downgrade is not approved or in process  with concurrent filing. 

 Other option file amendment for upgrade process from eb3 to eb2 if the existing downgrade is approved.

I don't know how many downgrade and upgrades can be filed with single I140.
