@csrcsr bro, what are you doing now? Doing a refile/intefile with 485j now or waiting for your date to become current??
Mine is Feb 2013.. my EB3 140 ki inka approval raledu… my new attorney is suggesting that I request for premium processing of that pending I140.. so that the new employer can file I485J with eb2 I140

Yaa bro that is safest so underlying 140 gets approved if it's Texas service center are they accepting premium easily now a days??

If my pd becomes current in eb2 final date yes planning to interfile with 485j assuming March bulletin

Don’t know about the I140 premium acceptance.. have to try it..

even if it costs 2500, I am thinking of following the attorneys suggestion and get the EB3 I140 approved.. what do you think?

My premium request was accepted by TSC because my FAD is current and it was approved yesterday.

Here is the reply from fragomen:

 

If you find yourself in a situation where your priority date is only current for final action in the EB-2 category and not EB-3, we can submit a transfer request interfiling and ask that USCIS attach your pending AOS to the EB-2 I-140 approval and adjudicate accordingly. You would not need to file another I-485. You should be eligible for this request even though the EB-2 I-140 approval lists your previous employer because your case was portable when you moved to XYZ. In case you are interested in reading more about the transfer request process, I am sharing a link to the USCIS policy manual outlining same. I hope that helps! Have a nice evening.
