Hie all,

I stayed in my uncle’s house on goodwill for good 1 year and my wife frequently visits she has job in another state and we have address proof as our uncle’s home address for now.my uncle never asked for any written or oral agreement from us to pay and he let us stay on goodwill without any problems. Some family issues happened within family and he is now asking us to pay over 12,000 dollars for all the months we stayed and if not he will report aganist us for not paying the money and staying in the home for free. what shall we do? Is this right what he is doing? Without any formal agreement such as lease, are we liable to pay?

If there was no written rental agreement between you both, you don't need to worry.

Ltt to experts.

There was no agreement as he is my uncle he asked us to stay on goodwill and said don’t worry but now he is asking us to pay as some issues happened in family. He wants to take it legally for the payment. I told him I will not pay as you did not mention it to me before and telling me now after 1 year doesn’t make any sense.

If both are you working then just pay it off as he has allowed you to stay for 1 year , this is morally a better choice

but with out any agreements not sure if you had to pay anything actually , you will be better off consulting a lawyer rather than asking this question in db if you want to play the hard ball

Had you rented the room from stranger how much would you have paid for that accommodation ?

Negotiate and pay that bro.

You don't really need to have a written agreement ...a VERBAL Agreement (even if a text message ) is also valid if he decides to sue you in a Small Claims court ($5k max limits for such courts) , If you recollect a year ago you may have said.. I will give you some thing or pay x amount etc.. it is still valid...

I understand that you have family issues now but he helped you by keeping you and your wife in house for 1 year which may have increased expenses (Utility ,Grocery etc).. there may be some issues now may be year or 10 later it will may get resolved. But if he drags you to court or go through all that the difference can/may increase.

Better to Negotiate and say you pay something
